Terms & Conditions

Preamble

These Terms and Conditions together with our Privacy Policy (the “Agreement”), govern the relationship between anyone using, accessing and being booked into a Property featured on this site and any of the content or services made available on it (“Guests”, “You”, “Your”), whether for business or pleasure purposes, and the Property Manager, Blue Bridge Property Services LLP, (a company registered in England with company registration number OC425030 whose registered office is located at 24 Bouverie Road West, Folkestone CT20 2TU), (“Us”, “We”, “Our”). This site provides a platform to enable potential Guests to book property and ancillary services via the site using third party online travel agents such as Airbnb, Vrbo and Booking.com as well as a channel manager to co-ordinate booking requests. Payment services are handled by a trusted third-party and potential Guests are subject to that third party providers’ terms and conditions which can be read via the link in clause 2 below.

Clause 1. The Contract

By using this site, You are confirming that you will contract with Us electronically and by booking or requesting to book a property, You are indicating your offer to stay at the property at the cost detailed on the site for the dates specified and subject to and in accordance with this Agreement.

Clause 2. Payment

You will pay 100% of the booking cost by debit or credit card at the time of booking through Our trusted third-party payment agent “Stripe” and You agree to be bound by their terms and conditions which can be viewed at https://stripe.com/gb/privacy.

Additional Payments may be requested directly by Us after the booking has been confirmed for ancillary services such as additional linen usually required during Your stay or for Parking which can only be pre-booked a short time before the check in date. Similarly Experience Packages such as Brewery Tours and Gin Tasting and Extra’s such as Flowers and Chocolates etc must be paid for in full by debit or credit card by telephone or by BACS transfer, the bank details of which will be supplied at the time of Your request. All charges accrued during Your stay including “pay for” Goodies in the Properties, must be paid in full prior to departure. We will take from any deposit held or charge any card We have pre-authorised, payments that are outstanding on departure.

Clause 3. Messaging

You will be sent emails or SMS text messages and reminders for information We require to complete Your booking. The first message You receive will either be a message confirming Your requested stay, advising about parking facilities at that particular Property and a reminder of the House Rules, or it may be a request for further information if you have not uploaded an identification document, an email address or contact telephone number which are required to enable You to book directly.

Clause 4. Booking Confirmation

Once You’ve received a booking confirmation message, a legally binding contract is in force, and You have agreed to these Terms and Conditions and the House Rules both of which are published on the booking site for You to read before booking Your stay. If You did not read this Agreement in full when booking, please do so now as You are bound by them during Your stay. If, after reading the Agreement, You now believe You will be unable to comply, please read Clause 5 below which deals with Cancellation and Refunds.

Clause 5. Cancellation and Refunds

You may cancel Your confirmed booking and receive a full refund of the initial payment if the cancellation is made electronically 7 full days before the check in date.

Confirmed bookings cancelled within 7 days of the check in date will receive no refund.

Clause 6. The Information File

Each of Our Properties has a specific information file which provides a full and detailed Inventory of the contents of each property as well as the current condition of all items listed in that Inventory. Unless stated otherwise, each item has been confirmed as present and is either new or in good order and clean. You should check the Inventory on booking so you can see what you need to pack! The Inventory is checked by housekeeping staff who sign off each Property after it is checked and cleaned between each booking to ensure any missing or damaged items or lost property can be correctly attributed to the last Guest. We strongly recommend that You check the Inventory on arrival for accuracy. If any item is missing or not in the state recorded, please call Us immediately so We can take appropriate action.

The Information File also contains the WIFI code and the operating instructions for all equipment in the Property as well as useful information like the nearest shop, doctor, taxis etc and details and online reviews (from their sites) for local restaurants.

Clause 7. Occupancy

You agree that all individuals of any age (including babies) have been declared on the booking site and that unless written consent from Us is given, no more or different persons than those declared in the booking shall be permitted in the Property at any time during the period of the booking. Each Guest must be made aware of this Agreement and agree to comply or be directed to comply (children) with them. Some of Our Properties are unsuitable for children either because they have Listed Building features such as low window ledges or cannot be sound proofed, so it is imperative for safety and the convenience of all occupants that accurate Guest information is provided. Breach of this Clause may result in immediate eviction especially if other Guests or Tenants in the same building are inconvenienced by such a breach. Guests are requested to check their messages regularly for updated information about their stay.

Clause 8. Condition and Use of Property

The Property is provided in “as is” condition and as recorded in the Inventory. We will use Our best efforts to ensure the operation of all amenities in the Property, such as internet access, washing machines etc as applicable. We shall not be held responsible for the failure of such items but will make every effort to correct any issues as quickly as possible after it is reported. If an issue needs immediate attention, please call the emergency number listed in the Information File. Numbers are provided to cover such events 24 hours per day 7 days per week.

Guests acknowledge that use of amenities involve potential risks if improperly used or unsupervised, particularly with regard to children and such use is therefore at the Guest’s own risk. Full operating instructions for all amenities within the Property are provided in the Information File but if in doubt telephone the appropriate call out number.

Guests must use the property for residential purposes only and in a careful and considerate manner to prevent any damage or loss to the property. Guests should leave the property in a clean and sanitary condition. Guests and any additional permitted visitors must observe the House Rules and refrain from any use which would disturb, annoy, endanger, or inconvenience neighbours. Guest must not use the property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.

Clause 9. Breach

If You fail to comply with the Terms and Conditions of this Agreement, You shall immediately forfeit your licence to occupy the Property and surrender the keys upon being notified of the breach, remove all Your belongings and leave the Property in good order and free of damage. No refund of any portion of the Rental Fee shall be given to You and if damage, loss or additional cleaning incur costs, We shall recover this sum directly from You and if any legal action is necessary; the prevailing party shall be entitled to reimbursement from the other party for all costs incurred on a solicitor and own client basis.

Clause 10. Assignment and Subletting

You shall not assign or sublet the Property, nor permit the use of any portion of the Property by other persons who are not declared Guests on the Booking site or family members or visitors of the Guest for whom written permission has been given to visit but not sleep at the Property.

Clause 11. Lost Property and Indemnification

You agree that all personal property, personal effects and other items brought into the Property shall be at Your or any permitted visitors sole risk with regard to any theft, damage, destruction or other loss. We shall not be responsible or liable for any reason whatsoever.

You hereby covenant and agree to indemnify Us, Our agents, Owners, Successors, Employees and Contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, legal fees incurred by You, permitted visitors or agents, representatives or successors of You or permitted visitors due to any claims relating to damage to or destruction of property or injury to persons or loss of life sustained by You or permitted visitors in or about the Property.

Clause 12. Entry and Inspection

We reserve the right to enter the Property at reasonable times and with reasonable advance notice to inspect the Property for Insurance and valuation purchasers, if this cannot be arranged on a date outside the period of Your stay. We will endeavour to do this at a time which will cause minimal inconvenience to You. If We have a reasonable belief that there is imminent danger to any person or property, We may enter the Property without advance notice.

Clause 13. Unavailability of Property

In the event that the Property becomes unavailable for use after Your booking but during the period of Your booking, due to reasons, events or circumstances beyond Our control, We will use good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value. If such replacement property cannot be found, We shall immediately return all payments made by You, whereupon this Agreement shall be terminated, and You and We shall have no further obligations or liabilities to each other.

Clause 14. Additional Provisions

In addition to the standard terms included herein, You acknowledge and agree that the following additional terms and conditions apply to the Your rental of the Property:

14.1 You must be 18 years or over when You book Our Property.

14.2 We reserve the right to refuse to accept any booking for whatever reason and without explanation.

14.3 Unless agreed otherwise in writing; You may check into Our Property after 3pm on the start day of your booking and, leave by 11am on the last day.

14.4 We expect the Property to be left in a reasonable state on departure. If it is not, and additional cleaning is required on departure, the cost of this cleaning will be charged as an additional charge.

14.5 If a one bed Property is booked for 2 guests but additional bedding is requested for the sofa bed, this will incur a charge of £15 extra per stay to cover the additional cost of laundering. No charge will be made if more than 2 Guests are declared on booking as the bedding will be included in the extra person charge.

14.6 A Deposit of £100 or preauthorised Credit Card details may be required to cover any loss or damage to the Property. If taken, We will attempt to notify you within 48 hours of your departure, but in any event before the next Guest is due to check in, if there are any issues arising from your stay. We will contact you by message or telephone and send photographs of the issue and an estimated cost of repair/replacement/additional cleaning costs involved. These costs can be charged up to five (5) working days after You have left the property.

Clause 15. General Provisions

This Agreement contains the entire agreement between the You and Us with regard to the rental of the Property and ancillary services, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both You and a representative of Our company. This Agreement shall be governed by the law of England and Wales and the Courts of England shall have exclusive jurisdiction over any matter arising from it.

The waiver or failure to enforce any breach of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing which shall include email and postal correspondence.

Schedule 1 – House Rules
  1. No Pets – sorry but we offer hypo-allergenically clean Properties so cannot accept any pets.
  2. No Smoking – anywhere in the property and not within 20 metres of any entrance to the Property.
  3. No Parties or Events – there are lots of local restaurants and venues that will accommodate you.
  4. All Guests in Our Properties are asked to observe Quiet Hours between 10pm and 7am – not everyone is staying for pleasure and workers need a good night’s sleep.
  5. Please remove shoes in the apartment. Also, please note that wooden floors accentuate noise and bare feet/hard soled footwear can be heard in adjacent flats. Please wear socks/slippers for the comfort of all our guests.
  6. Please DO NOT allow doors to slam.
  7. Please DO NOT feed the seagulls – they are very feisty!
  8. Please DO NOT light candles in the Property. They will activate the smoke alarm and if this requires an engineer to re-set, You will be charged the call out fee of £50.
  9. Please DO NOT remove towels from the apartment, they are NOT for use on the beach.
  10. Excessively soiled linen and towels will incur a charge of £5 pre-treatment per item. Special make-up flannels are provided with micellar water for removal of make-up and tanning products. Please use these to avoid staining the towels and bed linen.
  11. Please DO NOT wash the towels provided. If you require a fresh set, please contact us to arrange.

Please note, If your booking is for a stay of more than 7 days, it is a requirement of our terms that the apartment has a mid-stay clean,including a change of bedding, towels & tea towels for which the Cleaning Fee paid on booking will be requested. This ensures the apartment remains in a pristine condition for your comfort and the longevity of the fixtures and fittings being used.
